Bill allowing for electronic delivery of notices passes Senate and Assembly

A bill, A.1683A that would permit all insurance notices and documents to be delivered electronically successfully passed both the Assembly (140-0) and Senate (62-0) on June 18.

Currently, most insurance notices can be sent electronically as long as the policyholder consents to receiving notices in that manner. However, the exception is that electronic delivery of notices is not allowed if a statute or regulation specifically provides for a document or notice to be “mailed.” There are several statutes and regulations that still reference delivery by “mail.”

Under this bill, all insurance notices and documents would be permitted to be sent electronically as long as the consumer affirmatively consents to receiving the notice in that manner. Insurers will be required to provide consumers with a clear notice of their rights before consent is given and the consumer can withdraw their consent at any time.

The bill will now go to the governor for his consideration.
