ISO GL program changes approved in Connecticut

The Connecticut Insurance Department approved the new 2012 Commercial General Liability Program filed by the Insurance Services Office Inc., which includes a forms filing, rules filing and loss-costs filing. Forms and endorsements affected by the filing will carry an edition date of April 2013. The proposed effective date for this program is Sept. 1, 2013.

To give you an idea of the scope of the forms filing, there are 11 topical changes, where many of these changes have been incorporated into multiple forms and endorsements. There are 21 changes to the endorsements portfolio, which result in six new endorsements, 80 revised endorsements and one withdrawn endorsement.

Below are some of the highlights of the filing:

  • a new optional Primary and Noncontributory–Other Insurance Condition (CG 20 01) endorsement is introduced to satisfy an underlying written agreement that requires coverage for the additional insured to be afforded on a primary and noncontributory basis;
  • a new optional Additional Insured–Owners, Lessees or Contractors–Automatic Status For Other Parties When Required In Construction Agreement With You (CG 20 38) endorsement is introduced to provide additional insured status to all parties the policyholder agrees in writing to insure; not just the parties directly contracting with the policyholder; and
  • an exception to the liquor liability exclusion is added for patrons who bring their own alcoholic beverages for consumption on the insureds premises, whether or not a fee is charged or a license is required.

As usual, there are Connecticut-specific exceptions to the multistate filings. The following endorsements do not apply in Connecticut: Liquor Liability Coverage Form (CG 00 34); Designated Location(s) Aggregate Limit (CG 25 14); and Supplemental Extended Reporting Period Endorsement (CG 27 10). A new Connecticut–Designated Location(s) Aggregate Limit (CG 31 36) endorsement is introduced. In addition, minor revisions have been made to four Connecticut Changes endorsements (CG 26 27, CG 26 29, CG 27 24 and CG 33 48) and the Connecticut Employee Benefits Liability Coverage (CG 27 21) endorsement.
