Failure to file NYDFS cybersecurity Certification of Compliance

The New York State Department of Financial Services sent notifications under the subject: "Failure to File Certificate of Compliance" and/or "Failure to File Certificate of Exemption" to many agencies and agents who have already correctly and in a timely fashion filed these certifications with the NYDFS via the NYDFS cybersecurity portal.

If you did receive this notice, then we recommend you do one of the following based on which of the following three scenarios applies to you and/or your agency:

  • You submitted a Certification of Compliance and/or Exemption with the NYDFS prior to the Feb. 15 deadline AND you have the confirmation email(s) that the NYDFS sent when you filed. Send an email to cyberregcomments@dfs.ny.gov with the full name of the licensed entity, license number and confirmation number from your filing and the NYDFS will look into your inquiry. Include a confirmation for each delinquency notice you received (Certificate of Compliance and/or Certificate of Exemption).
  • You submitted a Certification of Compliance and/or Exemption with the NYDFS prior to the Feb. 15 deadline AND you DO NOT have the confirmation email(s) that the NYDFS sent when you filed. You should log on to the cybersecurity portal and resubmit your Certification of Compliance and/or Notice of Exemption and retain the confirmation emails.
  • You DID NOT submit a Certification of Compliance and/or Exemption with NYDFS prior to the Feb. 15 deadline. You must submit this/these Certification(s) ASAP via the NYDFS cybersecurity portal.
