Ask PIA: Refusal to write based on applicant's age

Q. In Connecticut, an insurer who writes a homeowners or personal auto policy is refusing to write a personal umbrella policy on the basis of the applicant’s age. Is this discrimination? A. Section 38a-358 of the Connecticut General Statutes squarely addresses unfair discrimination in the issuance, declination and renewal of personal auto insurance; among other prohibitions, refusing to write based solely on the applicant’s age, sex or marital status is prohibited (but not if there is another company in the insurer group that would not decline coverage for the same reasons).
