A new law (Chapter 490 of the Laws of 2011, effective November 15th) will create a new category of risk which can be written by New York-licensed carriers free of rate and form approval requirements. It does so by using the existing Free Trade Zone (Article 63) provisions, and adding a new, “Class 3” category within the Free Trade Zone (FTZ).

As soon as PIANY members see the words “Free Trade Zone,” they may think, “Hey, this won't affect MY business.” But unless you write strictly personal lines, this may not be the case.

NJ PAIP/CAIP (Automobile Insurance Plan) Producer Procedures Course

PAIP/CAIP certification is required every four years, from the date of your last certification course. This course, offered by webinar, consists of two webinars, Parts 1 & 2. Both parts must be completed for PAIP/CAIP certification; the course must be completed in no more than two sessions. All sessions must be completed by the same person. Session 2 must be completed within 12 months of Session 1.

Knowing the distinct regulatory requirements is vital to the competent placement of workers' compensation insurance in these three states. Agency principals, producers and customer service representatives who are involved in the placement of workers' compensation insurance. This program should be attended to reduce the likelihood of making costly errors in the multistate placement of workers' compensation insurance.

Many agencies transact insurance in multiple states, and it is even more likely to be the case when these states share a border. This program will highlight certain coverage and regulatory distinctions for the three states of Connecticut, New Jersey and New York, which are served by the Glenmont PIA office.

This program will focus on making state comparisons for workers' compensation insurance, such as:

PIANY 's Technology Consultant Donna Barr, AIT, ACE, presents a one-hour Webinar, where she'll explain how an agency can use its agency management system to produce disclosures called for by Regulation 194 and maintain required records. She'll be joined by PIANY 's Matthew F. Guilbault, Esq. , who can address participants' questions about the Regulation itself.

An expert on agency workflows, Barr has developed procedures that can be used with any system capable of generating client letters. She'll explain how:

  • System administrators can create activity codes and disclosure forms
  • System users can generate compliant disclosures
  • Agency managers can track disclosure activity for compliance
  • Records can be maintained/retrieved electronically

Agent tested! The workflow Barr will explain has been pre-tested by PIANY member agencies using a variety of management systems. System users contributed their practical suggestions that have been incorporated into the final workflow design.

Matthew joined PIA in 2007 as government affairs counsel for PIA, prior to becoming director of government and industry affairs in 2009. A graduate of Albany Law School of Union University and he received his bachelor of arts degree from the College of Saint Rose, and he brought to the association more than a decade of legal and association experience.

Matthew has been personally involved with PIA's discussions with the New York State Insurance Department since it announced the disclosure regulation in February 2009, and he coordinated the all-industry effort to block it prior to its promulgation at that time. He is responsible for working with PIA's Agent and Broker Compensation Disclosure Task force, which has spent countless hours meeting with Department officials, drafting and delivering input and suggested changes to the department's draft circular letter to make sure that—if it goes into effect as scheduled—compliance will be as easy and non-invasive as possible.

Donna Barr comes from an "insurance family." She began by helping out in the family agency when she was only 14. Donna's father, Larry Jurgensen, a PIANY member, owned Jurgensen Brokerage on Long Island. After 11 years in the family agency while completing her education (including a degree in banking, insurance and real estate), Donna worked for other well-known insurance brokers (including Brown & Brown, Marsh and, most recently, Leavitt Group), before going out on her own as a consultant.

She has fulfilled job responsibilities as CSR, producer, manager, business analyst, accounting manager, system administrator, project manager and director of performance and agency operations.

In the summer of 2009, Donna moved to Florida to form Donna Barr Consulting and purchase an insurance agency, Premier Insurance Consultants of the Treasure Coast Inc.

Donna specializes in workflows, training and agency interface. She has worked with various agency management systems over the years. She volunteered as a pilot agent for many carriers embarking on download and Real Time, with over two decades experience in agency/company electronic interface.
