Additional Insured status and certificate transactions cause many errors and omissions claims against agents. When an insured fails to secure the requested additional insured status per a contract executed with a third-party there is a breach of contract. Named insureds often try to blame the agent for failing to meet the terms of the contract and sometimes the party expecting additional insured status sues the agent directly as a third-party beneficiary claiming the agent had a duty to protect them based on the agent's knowledge of the relationship between the named insured and third-party.
